Case summary
An objection on the contents of the affidavit was raised and the court considered whether the affidavit was fatally defective. The court held that though the affidavit was defective, it was curable. That an argumentative affidavit offended the rules and would be struck out. And since the supporting affidavit had been struck out, the application would be dismissed.
