- The court considered whether the matter was time barred, and whether the appellant had been unlawfully retrenched and whether he was entitled to the relief sought. The court held that as the retrenchment had taken long before the application to set it aside, it would be ingenuous to allow it. That the there was no distinction from common law contracts and the employment contract as they were all governed by the law on limitation.
