Case summary
From the evidence that was on record, it was found that the Justices of Appeal had properly re-evaluated all the evidence that had been adduced. It was thus found that the court rightly found that the appellant was fraudulent. The sale was done before the time it as supposed to have been done in, the returns of the sale indicted differing sums of money, and all this acts were done with the knowledge of the appellant. Thus he could not be termed as bona fide purchaser for value without notice.   In the result, the title could not be reverted back to the appellant. Accordingly, the appeal was dismissed with costs to the respondent.
