As regards the first ingredient, it was agreed that death occurred. Concerning the second ingredient, it was proved that death was caused by a fractured skull occasioned by a blunt object, and that the death was not accidental.
With regard to whether malice was involved, the court found that of injury was deep that it resulted into a fracture. And the stick that was used in the attach was found to be heavy and dangerous. Further that the head on which it was applied was a very vulnerable body part. All this evidence showed that there was intention to kill.
Further, concerning participation, it was found that A1 was at the scene of crime and was seriously involved in the act, as the person who hit the deceased. The court found that A2, A3, A4 and A5 were in the garden with other people at the time the incident occurred, thus they were not involved in the act.
The court thus found that the prosecution had proved beyond reasonable doubt that A1 with malice a forethought caused the death of the deceased.
Accordingly, A1 was found guilty was thereby convicted of murder.
