Court considered whether the prosecution of the plaintiff was malicious and whether he was entitled to the reliefs he sought for. Court held that the plaintiff had indeed been maliciously prosecuted and held that he was entitled to some to reliefs sought for. Court was satisfied from its findings that the plaintiff had proved that the defendant had instituted and continued criminal proceedings against him, without reasonable cause while acting maliciously and the criminal proceedings had been terminated by court in favor of the plaintiff. For that matter the plaintiff was entitled to remedies of special damages, general damages and exemplary damages with interest payable by the defendant plus costs of the suit.
Accordingly court gave judgment in favor of the plaintiff.
