The court considered whether there were ingredients of aggravated robbery contrary to provisions of the penal code act in the present case. Court held that all the ingredients had not been proved beyond reasonable doubt in the present case. Court was satisfied form the evidence adduced that there had been theft accompanied by violence with a deadly weapon however prosecution could not successfully connect the accused to the scene of crime. The accused person’s defense of alibi was not destroyed by prosecution evidence to rightly place him at the scene of crime. There was no correct identification given the fact that incident happened at night.
Accordingly court acquitted the accused person of aggravated robbery.
