Court considered whether the plaintiff had lawfully bought the vehicle and whether it was impounded by the defendant’s agents. Court held that the plaintiff lawfully bought the motor vehicle and also held that indeed it had been impounded by defendant’s agents. Court was satisfied that the plaintiff had adduced sufficient evidence to have bought the vehicle lawfully and since it was taken and kept at a police station that clearly showed that it had been impounded by defendant’s agents.
Court considered whether there was loss suffered by the plaintiff and remedies available to him. Court held that the plaintiff had proved no loss incurred. Court was satisfied from the evidence brought to court that the plaintiff had failed to prove special damage however court awarded him general damages and amount of the scrap vehicle with interest to be paid by the defendant.
Accordingly court entered judgment in favor of the plaintiff the suit.
