RULINGS:

This is an application for orders that WALUGEMBE AARON CYRUS and WALUGEMBE RUMANYIKA JEAN HARRIET be appointed legal guardians of NABISERE NICOLE CAROL and WALUGEMBE JUUKO NICANDER (both infants) for the purpose of dealing in and particularly mortgaging Land comprised in Block 266 Plot 817, Land at Seguku.


The application which was by a notice of motion was supported by the affidavit of WALUGEMBE AARON CYRUS and is on the ground that the said infants are biological children of the petitioners and they are all registered as proprietors of the Land and that it is the interest of the children that their parents mortgage the property for the purpose of raising funds to develop it.


The petitioners were present when this application was made and so were the two children.


After studying the application and the affidavit in support and after listening to submissions of Mr. Thomas Ochaya, counsel for the petitioners I am satisfied that it is in the best interest of the children if this application is granted to enable the adult proprietors of the Land Mortgage it for the purpose of raising funds to finance its developments.


In the result WALUGEMBE AARON CYRUS and WALUGEMBE RUMANYIKA JEAN HARRIET will be appointed legal guardians of WALUGEMBE NABISERE NICOLE CAROL and WALUGEMBE JUUKO NICANDER for the purpose of dealing in Land comprised in Block 266 Plot 817 Land at Seguku which is jointly owned.

The petitioners will pay the costs of this petition.
