- The court found that the evidence showed that the respondents attacked the complainant thereby injuring his jaw and leg. It was stated that the respondents were the actual aggressors, and that they shared a common intention. The prosecution had properly defeated their defense. Further it was noted that had the trail magistrate properly evaluated this evidence, he would have convicted both respondents. The appeal was therefore allowed and the decision of the trail court quashed. The appellant court made an order for the award of compensation to the complainant.
