Case summary

Court held that as per the evidence of identification, there were major contradictions going to the roots of the case which destroy it and the only inference is that the conditions did not favour proper identification in the circumstances. That if both witnesses knew the accused persons very well before, they did not reveal their names to the police when they made their statements. Additionally, there was no evidence to show how the gun and the empty cartridges were recovered.
