- Case summary
- The court considered whether the appellant’s action was time bared. The court held that where there had been an acknowledgement of a claim the limitation period was deemed to have started running from the date of such acknowledgement. The court was not satisfied that the government had acknowledged liability for the appellant’s claim as there was no evidence to that effect. The court accordingly concluded that the suit was time barred and upheld the trial court’s judgment.
