The court held that as an appellate court, they can interfere with the decision of the trial court if it was reached at erroneously based on a wrong principle of the law amounting to a miscarriage of justice. That though there was no arithmetic deduction, the trial judge mentioned the time spent on remand as a factor in the sentence reached.
