- Court re-evaluated the evidence on record and discovered that the light that enabled was of moonlight and a tadooba but the witnesses were not known to the assailant. That this could have been addressed by holding an identification parade that was not done making the conditions of identification suspect. Court thus held that prosecution failed to prove the participation of the appellant in the murder and quashed the conviction.
