Case summary
The court noted that as a first appellate court, it has a duty to re appraise the evidence and reach an independent decision. That the appellate court can only interfere with the decision of the trial court if it is reached basing on a wrong principle of law and leading to a miscarriage of justice. That before an appellate court sets aside a decision of the trial court, the decision must be illegal. That thought the deduction of the time spent on remand was not done, it was considered and hence didn’t prejudice the appellant.
