The Court of Appeal granted the application for bail on the grounds that the applicant suffered grave illness to afford him an opportunity to access better facilities than those at prison. That there was a likely delay in disposal of the appeal which may result into a miscarriage of justice. That there are high levels of congestion at the prisons which may aggravate the applicant’s medical condition. Additionally that the sureties presented were substantial enough to ensure that the applicant attends trial of his appeal. Conclusively court stated that the applicants’ right of innocence is not completely extinguished having exercised his right of appeal..
