DECISION/RULING

This decision arises from the directive of this court in a ruling in the above suit pursuant to an application of the Plaintiff’s Counsel for judgment on admission. The Court delivered its ruling on the 20th of July 2012.

In that ruling I directed that the Defendant shall communicate its written final position on the Plaintiffs claim in accordance with the request of learned Counsel for the Defendant during the preliminary hearing held on 28 June 2012 before the court decides whether to enter judgment. The decision of the court with respect to the application was stayed pending the awaited communication which was to be made within one week from the 20th of July 2012.

In a letter dated 24th of July, 2012 by the Assistant Commissioner Litigation of the Respondent/Defendant and filed on the court record on the 25th of July 2012, the Defendant communicated in writing the decision of its management approving payment to the Plaintiff of a sum of Uganda shillings 22,596,603 of/= as 10 per cent reward from part taxes recovered from a taxpayer pursuant to information given by the plaintiffs.

In accordance with order 12 rule 1 (2) and order 15 rules 7 of the Civil Procedure Rules and by agreement of the parties at the preliminary hearing/scheduling conference, partial judgement is entered for the Plaintiff in the sum of Uganda shillings 22,596,603/=. The remaining issues in the suit and as contained in the scheduling memorandum of the parties shall be determined through trial of the suit in the ordinary way unless otherwise agreed or ordered.

This decision is made this 31st day of July 2012.  The decision of the court shall be communicated to the parties by the registrar of this court.  The honourable registrar shall summon the parties to deliver the decision of this court as aforesaid.
