JUDGMENT

Upon hearing Counsel for both Parties:

1. In view of the defendants and their Solicitors not turning up and in view of the Counsel with holding brief here refusing to proceed and defendant’s witness not being present, the judge rightly proceeded to entering judgment and further correctly made the Order under order 18 and Rule 13.

The leave to appeal is therefore refused.

2. The Defendants are given leave to file the counter claim within 14 days. If counter claim not filed proceed to write judgment.
