The court considered whether the trial judge
had failed to properly evaluate the evidence
in deciding the 1 st appellant’s qualification
Court held that the appellant was not a
registered voter and was therefore ineligible
to contest for elections. Court added that the
1 st appellant had no right to adopt a set of
names without following the right legal
procedure.
Court accordingly held that the trial judge
rightly held that the 1 st appellant had failed to
prove the authenticity of his academic
qualification.
The appeal was disallowed and court
declared the respondent a validly elected.
