Supreme Court of Uganda

The Supreme Court of Uganda is the highest judicial organ in Uganda. It derives powers from Article 130 of the 1995 constitution. It is primarily an appellate court with original jurisdiction in only one type of case: a presidential election petition.

The Supreme Court is headed by the chief justice nd has ten other justices. The quorum required for a court decision varies depending on the type of case under consideration. When hearing a constitutional appeal, the required quorum is seven justices. In a criminal or a civil appeal, only five justices are required for a quorum.

Interim injunction refused where applicant failed to prove credible possession or imminent threat despite a pending appeal.
* Civil procedure – interim injunctions under Rule 6(2)(b) of the Judicature (Supreme Court) Rules – three conditions: competent notice of appeal, substantive application, serious threat of execution. * Appeal procedure – competency of Notice of Appeal – applicant for interim relief need not be the party who filed the appeal. * Possession disputes – credibility of evidence of occupation and effect on balance of convenience and preservation of status quo. * Interim remedies – courts will not grant orders in vain where status quo already altered or applicant fails to show imminent threat.
