HC: Land Division (Uganda)

The Land Division is a Division created at the High Court Head office at Kampala.

The Division is charged with the following functions:Responsibility of supervising the work of Land Tribunals, the adjudication of all land related dispute fall under this Division. The land Division is established with three judges with a separate registry for the Division .There is a Registrar for the Land Division who doubles as the Registrar of the Land Tribunals. A desk office was also established under the office of the Registrar to handle the activities of the District Land Tribunals.

Expropriated Properties Act 1982 – nullification of pre‑existing transfers and mortgages upon Act’s commencement; Minister’s exclusive power to issue repossession or purchase certificates; procedural requirement to appeal Ministerial disposals under s.14 and Regulation 15 within 30 days; DAPCB lacks power to grant repossession certificates; court will not set aside Ministerial certificate absent statutory appeal/hearing.

* Contract law – sale of land – clear contractual language determines purchase price. * Contract variation – interpretation of deed and whether it alters original sale price. * Breach of contract – failure to pay agreed balance constitutes breach. * Eviction law – wrongful eviction under warrant for distress where tenancy and rent arrears not proven. * Damages – strict proof of special damages by invoices and evidence.
