A Magistrate lacked jurisdiction to hear a land suit filed after 2 July 1998; those proceedings were void and set aside.
Land law – jurisdiction of Magistrates’ and Local Council Courts – effect of Land Act 1998 (Act 16/1998) and Land (Amendment) Act 3/2001 – amendment extends time to finalise pending cases only; proceedings in courts without vested jurisdiction are void – revision under s.83 CPA.
