Applicants failed to prove respondent’s negligence; court found plaintiffs’ driver at fault and dismissed the claim with costs.
Tort — Negligence — Motor-vehicle collision — Burden of proof on plaintiff to prove defendant’s negligence — Res ipsa loquitur inapplicable where plaintiff fails to establish specific negligent act or absence of explanation. Evidence — Credibility and corroboration — absence of independent eyewitness, police report or sketch plan undermines plaintiff’s case. Vicarious liability — pleaded but not established where servant’s negligence not proved.
