The accused’s ambush defence rejected; prosecution proved attempted murder causing permanent amputation; sentenced to eight years.
Criminal law – Attempted murder – Elements: positive intention to cause death; overt acts proximate to commission – application of statutory definition of attempt. Evidence – Identification and credibility – related witnesses and minor inconsistencies do not necessarily undermine prosecution where testimony is otherwise consistent and convincing. Alternative verdicts – Court may decline lesser conviction where cogent evidence supports attempt charge. Sentencing – Seriousness of harm and period on remand weighed in imposing custodial term.
