High Court of Uganda

The High Court of Uganda is the third court of record in order of hierarchy and has unlimited original jurisdiction, which means that it can try any case of any value or crime of any magnitude. Appeals from all Magistrates Courts go to the High Court. 

The High Court is headed by the Honorable Principal Judge who is responsible for the administration of the court and has supervisory powers over Magistrate's courts.

High Court may dissolve a customary marriage; partial dowry does not defeat validity and adultery (proved by child born apart) justifies decree nisi.
• Jurisdiction – High Court may hear and apply customary-law matrimonial causes under the Judicature Act. • Customary marriage – partial dowry payment can still validate marriage where balance is waived. • Divorce – adultery proven by birth of child while spouses lived apart; named co-respondent not proven. • Discretionary bars – no condonation, collusion, unreasonable delay, cruelty or desertion established. • Relief – decree nisi granted; custody to mother; maintenance for children; dowry return enforced. • Costs – petitioner ordered to pay full costs on magistrate scale.
