Case summary
The court held that Planning and the execution of an onerous assignment given in the wee hours of the night cannot be said to be forming a common intention to prosecute an unlawful purpose. That when the occupants of the ill- fated vehicle refused to stop after being flagged, they became a subject of lawful arrest and were deemed to have attempted to evade arrest. That the real question should have been whether the force they used was reasonable in the circumstances. That the shooting and attempting to stop the ill-fated vehicle was reasonable.
