Case summary
The court considered whether the transfer was voluntary. The court held that it had to be ascertained whether the consent was obtained by fraud, duress, threats or undue influence. The court was satisfied that there was no evidence of any fraud. duress or undue influence exercised on the lessor to give its consent to the transfer. The court accordingly concluded that the transfer was voluntary and dismissed the appeal.
