Case summary
The court considered whether or not to extend the time within which the applicant had to file record of appeal. The court held that an application for extension of time within which to file an appeal had to show sufficient reason before court could exercise discretion in its favour. The court was satisfied that the deputy registrar had erroneously issued a certificate of completeness of record upon which counsel for the respondent’s legal assistant rushed to file the record of appeal without ascertaining the defective decree.
