Case summary
Court considered whether there was death of a person. Court held that the death of the deceased is not in contention.  The post mortem confirms the death. The court considered whether her death was caused unlawfully. Court held that the law on homicide states to the effect that it is unlawful until proven otherwise. The evidence shows that the deceased was killed by a mob and was extra judicial and brutal. The court considered whether there was malice aforethought in the murder of the deceased. Court held that the assault was brutal and savage. The intention was to cause death. The court considered whether the accused participated in the murder. Court held that the accused were properly identified at the scene of the crime by the people who knew them very well in daylight.
