Case summary
On the issue of consent, court held that in the absence of discernibility in the evidence of the accused, it is difficult to assume that his evidence is not worthy of truth and belief. Accordingly, it is more probably than not that the accused had sexual intercourse with the complainant with her consent. In case of doubt the benefit goes to the accused.
