RULING

This is an application for legal guardianship brought under Sections 14(1) and 33 of the Judicature Act Cap 13; Sections 3 and 16 of the Children Act and Order 52 rule 1 of the Civil Procedure Rules.

The applicant Okello Charles was represented by Mr. Osauro John. In attendance were the infants Ocago Abraham and Ongeny Emmanuel aged below 18 years. Also in attendance were the mother of the infants Audo Florence and her elder daughter Akello Miriam.

The application is supported by the affidavit of Okello Charles who is the biological father of the two infants .

Okello Charles registered family property comprised in plot 270 Block 8 situate at Oburekori, Orupe Katete ,Serere district, in the names of the two infants, himself, his wife Audo Florence and daughter Akello Miriam.

He is desirous of securing a loan to develop the family business.

The grounds for allowing an application for legal guardianship is that it is in the best interests of the children.

I am satisfied that the applicant will be acting in the best interests of the children by securing a loan to develop the family business. As a person with parental responsibility, increased income will mean a higher standard of living for the infants. The infants were in court and i observed they were in good hands.

In the premises, the application for guardianship is allowed. I make the following orders,

  1. The applicant Okello Charles is appointed legal guardian of the two infants Ocago Abraham and Ongeny Emmanuel

  2. The applicant is authorised to take decisions on behalf of the two infants with regard to their registered interest in Plot 270, Block 8 situate at Oburekori, Orupe Katete , Serere district.

  3. Costs in the cause.
