RULING


The applicant applies for leave to file a substantive application for Judicial Review by way of prerogative reliefs of mandamus and certiorari as regards the decision and acts of the sub-county Chief, Apac District, whereby some written report was issued concerning a marriage relationship (or absence of it) between one Joyce Lanek and Richard Lanek, both now living in United Kingdom, and both involved in divorce proceedings.

Court, on the basis of what is disclosed in the affidavit of Muhumuza Julius, in support of the application, is satisfied that the issues raised are serious enough, to be inquired into by this court by way of Judicial Review.

Accordingly leave is hereby granted to the applicant to file an application for Judicial Review within the period prescribed by the Rules.

The costs of this application shall abide the event in the substantive application.
