RULING:


This is a petition for an Adoption Order. By the petitioner, REV. BEVERLY BRAUMULLER HAWVER and the infant, Kyalimpa Faith attended the hearing of the petition and so did the father of the infant, BENON TUHIRIRWE. The petitioner was represented by Mr. Wilfred Niwagaba, an advocate of this court.


Before the hearing of the petition, I had the opportunity to peruse the petition and study all the documents accompanying the petition. These documents include:-


  1. The petition by Rev. Beverly Braumuller Hawver.

  2. An affidavit in support of the petition by the petitioner.

  3. A certificate of marriage of the petitioner.

  4. A birth certificate of the petitioner.

  5. A confirmation that the petition does not have a criminal record.

  6. A confirmation that the petiton is a licenced foster parent in the state of Hawai.

  7. A letter of introduction from the Penval Christian Fellowship.

  8. A birth certificate of the infant.

  9. A consent of the petitioner’s husband to the adoption of the infant.

  10. A consent by the father of the infant to the adoption of his daughter.

  11. A recommendation from the probation and social welfare officer, Rakai District for adoption of the infant by the petitioner.


From the above pleadings and submissions of counsel for the petitioner this court is satisfied that the he petition fully complies with the requirements of the Law and the welfare principle which is the paramount consideration in an application of this nature dictates grant of this application.


In the circumstances, I order that an adoption order issue in favour of REV. BEVERLY BRAUMLLER HAWVER for adoption of Kyalimpa Faith, the subject of this petition. The petitioner is required to register this order with both the registrar general and the consider department of Foreign Affairs of the Republic of Uganda. The Registration in either case is to be effected within 21 days from the date of the issuance of this order.
