Case summary
The court held that as the second appellate court, it is only required to consider matters of law. That any transaction entered contrary to s 39(1) of the land Act is null and void and the couching of the section is mandatory. That the purchaser has a right to claim from any person with whom he entered into the transaction any money paid or any consideration given by him in respect of the transaction.
