Case summary
On existence of sexual intercourse court held that the medical examination report was not the major evidence but merely corroborative but could have been the basis of conviction. That lack of penetration could not exonerate the appellant as the appellant was found with the victim atop him having intercourse. On the sentence court considered the range of sentences and held that the sentence of 30 years was excessive and a 20 year sentence was more appropriate in the circumstances and after deducting time spent on remand, court awarded 18 years and four months from the time of conviction.
