- Court upheld the conviction holding that the victim was defiled in broad daylight and she knew the appellant as her cousin. That the evidence of the victim was corroborated by medical evidence. It was further held that the trial judge erred in law when he did not consider or deduct the period the appellant spent in custody hence the decision was held a nullity. Accordingly court reduced the sentence taking into consideration the mitigating factors.
