- The court held that the justices properly re appraised the evidence and reached a proper conclusion since the lynching took place in broad day light and the witnesses clearly saw the beating taking place. That Discretion in passing sentences against convicts must be exercised judicially by taking into consideration all the factors circumstances of the case and precedents set by court for similar offences.
